ACT Assumption of Risk and Release

An inherent risk of exposure to contagious diseases, including COVID-19, exists in any public place where people are present. COVID-19 is a highly contagious disease that can lead to severe illness, health complications, and even death. According to the Centers for Disease Control and Prevention (CDC), certain individuals, including those with pre-existing health conditions, may have a higher risk related to COVID-19 exposure and infection.

The institutions participating in offering the ACT examination have implemented enhanced health and safety measures in accordance with CDC guidance. Registrants are required to follow all health and safety measures at all times during the administration of the examination.

By registering for the ACT examination, you acknowledge that an inherent risk of exposure to contagious diseases, including COVID-19, exists in any public place. You understand that although the institutions participating in offering the ACT examination have undertaken reasonable steps to minimize the transmission of COVID-19, the institutions are not responsible in any manner for any risks related to COVID-19. In consideration of the institutions offering the ACT and for use of the institutions’ facilities, you voluntarily accept and assume all risks related to exposure to or transmission of contagious diseases, including, but not limited to, all risk of loss, damage, personal injury, sickness, or death. You further voluntarily release, waive, discharge, and covenant not to sue the State of Iowa; the Board of Regents, State of Iowa; the University of Iowa; the University of Northern Iowa; Iowa State University; and the Western Iowa Regional Resource Center; and any of their respective officers, agents, employees, and assigns from any and all claims, damages, injuries, losses, liability, cause of action or demand of any nature whatsoever which may be incurred, either directly or indirectly, in any way related to contagious diseases, including COVID-19.
